The Guarantees

1. GOOD WORK COMPLETION GUARANTEE

"Pierre de France" commit themselves to finish the work for the deadline and according to the specification established with the preliminary reservation contract. To this effect, they subscribe the guarantees recommended by the "code de la construction et de l'habitation" (building and dwelling code).

 

1.1. Guarantee relative to the sale of property purchased from plan for future completion

This guarantee replies to the obligation foreseen by the articles R.261-21 and following of the "Code de la Construction et de l’Habitation" relative to the sale of property for future completion.

  • This concerns the construction process of a private home under VEFA whose marketing resembles an individual home contract.
  • It is issued in the buyers favour and covers the completion of the property programme.
  • The vendor and the guarantor have the option, during the execution of the sales contract, to substitute the completion guarantee for the repayment guarantee and vice-versa.

It finishes upon completion of the building within the conditions provided for under article R.261-24 of the Code de la Construction et de l’Habitation.

 

1.2. Completion guarantee or refund

This guarantee replies to the obligation foreseen by articles R.261-21 and following of the "Code de la Construction et de l’Habitation" relating to the sale of property to be built.

  • This "Caution Mutuelle" (Mutual Guarantee) is only natural, acting in common with the Member Builder, in the capacity of all guaranteed parties, to pay the necessary amounts for completion of the property.
  • It finishes upon completion of the building within the conditions provided for under article R.261-24 of the Construction et de l’Habitation.






1.3. Housing estate completion - global guarantee

This guarantee is intended to guarantee the completion of the development work foreseen under article R.315-33b of the Code de l’Urbanisme (Town Planning Code).

  • This guarantee allows the member developer to market housing estate plots before the completion of the work stipulated by the administrative order.

It finishes upon completion of the building within the conditions provided for under article R.315-38 of the Code de l’Urbanisme.


1.4. Housing estate completion guarantee

This guarantee is intended to guarantee the completion of the work and is foreseen under article R.315-33a of the Code de l’Urbanisme.

  • This guarantee allows the member developer to market the housing estate plots and defer the finishing work without having to consign, on a blocked account, the amount equivalent to their cost.

It finishes upon completion of the building within the conditions provided for under article R.315-38 of the Code de l’Urbanisme.

 



 

1.5. Private works contracts payment guarantee

Home-buying group projects
The payment of work guarantee to the profit of the companies of the private market as foreseen under article 1799-1 of the Code Civil, can be made to a beneficiary member for the same project as the completion guarantee.

 

1.6. Private works contracts payment guarantee

Housing estate developments
The payment of work guarantee to the profit of the companies of the private works as foreseen under article 1799-1 of the Code Civil (Civil Code), can be issued by to a beneficiary member of the "global guarantee" or "completion guarantee".

 




2. PERFECT COMPLETION GUARANTEE

This counts for one year from the date of the works acceptance and covers all defaults noticed and reported in this one-year period. The builder is held to guarantee the project result and therefore, if necessary, complete the work, or repair a fault (Article 1792-6 of the code civil).

3. BIENNALE GUARANTEE

This guarantee covers all defaults that appear in the separable and dismountable building components; this means those of which the removal, the dismounting, or the replacement of which, can be carried out with deterioration to the support. This guarantee lies with the builders during 2 years counting from the acceptance.

4. THE TEN-YEAR GUARANTEE

It covers all damage compromising the solidity of the property that occurs in the 10 years following the acceptance of the accommodation. This guarantee comes into play in the presence of defaults affecting the accommodation and making it unsafe for its purpose.

5. BUILDING INSPECTION

Pierres & Territoires de France systematically has recourse to a building inspection office for each construction.

6. QUALITY LABELS

Attributed by independent agreed bodies, the labels form a group of guarantees for a new-home buyer.
